Unfortunately, a girl saying nothing still constitutes rape.

In most states, the girl must actually say that its ok in order for it NOT to be rape... which is bullshit. Even if they're all over you the whole night, before drinking, and you screw them while they're plastered, guess what? You're going to jail.
